Tycko & Zavareei, Public Justice, and Morgan & Morgan have been litigating a putative class action against JPay for the last seven years. JPay is a company that is contracted by prisons for friends and family members to transfer money to inmates. Unlike money orders sent through the post office, JPay charges excessive fees on money transfers, according to a press release by Public Justice.
Public Justice explains that JPay requires arbitration in their terms of service, but they have been avoiding arbitration claimants and potential class actions over the last seven years.
Karla Gilbride, co-director of Public Justice’s Access to Justice Project said, “Public Justice often challenges contracts like these where consumers don’t have any real choice or where the terms are unfair and one-sided...JPay can’t have it both ways—it can’t force its customers out of court and into arbitration but then run back to court when it doesn’t like the decisions the private arbitrators are making.”
